1. Definitions
These Terms and Conditions govern sales made by Julio Bárcena, ID 07234584A, with registered address in Sant Just Desvern, Barcelona, Spain (hereinafter “THE AUTHOR”), either through online channels (hereinafter “THE SITE”) or in person (hereinafter “EXHIBITIONS”), of his work (hereinafter “THE WORK”).
By making a purchase, whether online or in person, you (hereinafter “THE BUYER”) declare that you are of legal age, have the legal capacity to contract, have read these Terms and Conditions, and accept them in full without reservation. By accessing THE SITE, you agree to comply with these Terms and Conditions and guarantee the truthfulness and accuracy of the information you provide.
These General Terms and Conditions of Sale are the only ones applicable and supersede all previous conditions. THE AUTHOR may modify these Terms and Conditions at any time without prior notice. Such modifications will not apply to contracts concluded prior to their publication.
The Site is available in English, and you agree to enter into this agreement in English, hereby waiving any claim of invalidity related to the language or form of this agreement.
2. Scope of Application
The products sold on THE SITE are original photographic works, printed in limited editions, numbered and signed, and accompanied by a certificate of authenticity. Other related products may also be offered, including but not limited to: artist’s books, gift vouchers, special editions, etc.
For international sales, as the importer, THE BUYER is responsible for complying with the laws and regulations of their country, as well as any taxes, duties, or customs charges that may apply.
In some cases, THE WORK may be created on commission, subject to specific conditions regarding format, price, and delivery time.
5. Prices and Taxes
Prices are always stated in Euros (EUR) and include the applicable VAT in Spain, unless otherwise indicated. THE AUTHOR reserves the right to change prices at any time without prior notice.
Works will be invoiced at the rates in effect at the time the order is registered, unless otherwise stated. Ownership of THE WORK shall remain with THE AUTHOR until full payment of the indicated price has been received.
THE AUTHOR reserves the right to cancel or refuse any order if fraud, misuse, non-payment, or an existing dispute regarding payment for a previous order is detected.
6. Payment Methods
Online: Credit/debit card (Stripe, PayPal). Your banking details (credit card number, expiration date, etc.) are not communicated to THE AUTHOR.
In person: Card or cash (receipt or invoice available upon request).
For commissioned works, payment terms and conditions will be detailed in a prior written quotation, which must be accepted by both parties.
7. Orders and Delivery
Online Orders:
Select the desired product and format.
Add it to your cart and follow the purchase process.
Review and confirm your order details.
Accept these Terms and Conditions and proceed with payment.
You will receive a confirmation email once payment has been processed.
Delivery:
Works may be collected in person or shipped to the delivery address provided.
Shipping costs and estimated delivery times will be communicated before the order is confirmed.
For international orders, delivery times may vary depending on destination and customs clearance procedures.
8. Right of Withdrawal
Applicable only to online sales to private consumers (not businesses).
Not applicable to customised products or special commissions.
Period: 14 calendar days from receipt of the product.
Condition: The product must be returned in its original condition, unused, and with its original packaging intact.
Return shipping costs are the responsibility of THE BUYER.
9. Exchanges and Returns
If the product arrives damaged or is incorrectly shipped, THE AUTHOR will bear the costs of return and replacement.
For in-person sales, returns will only be accepted in the event of a manufacturing defect or damage not attributable to THE BUYER.
10. Intellectual Property
Purchasing a work does not transfer any reproduction, public communication, distribution, or adaptation rights.
Use of THE WORK is limited to private and decorative purposes.
The digitisation, copying, reproduction, resale, or posting on social media without written authorisation from THE AUTHOR is strictly prohibited.
Any commercial or public use requires prior written authorisation and a specific licence.
11. Data Protection
Personal data will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). You may exercise your rights by writing to [email protected].

12. Liability
THE AUTHOR guarantees the authenticity and quality of THE WORK.
THE AUTHOR shall not be held liable for:
Damages resulting from improper use or unauthorised handling.
Delays or incidents beyond his control (force majeure, customs procedures, international transport delays).
13. Governing Law and Jurisdiction
These Terms and Conditions are governed by Spanish law.
In the event of a dispute, the parties shall seek an amicable resolution.
If no agreement can be reached, the courts of Barcelona (Spain) shall have jurisdiction, unless otherwise stipulated by mandatory legal provisions.
